Hills Antenna Limited Lifetime Warranty (Warranty)

1. Lifetime Warranty

• 1.1 This Warranty is provided by the manufacturer, HillsATV Pty Limited ACN 636 174 966 (Hills ATV), having its principal place of business at 38 Heath Street, Lonsdale SA 5160, Phone 08 7079 6797 warranty@hillsatv.com.au
• 1.2 On and subject to the terms in this Warranty (including the requirements in clause 4 below), Hills ATV guarantees that the Hills Tru Series Antennas listed in the table below, or supplied in packaging marked with a Lifetime Warranty Sticker (Hills Antenna Products) purchased on or after 1 April 2022 will, subject to the exclusions in clause 3 below, be free from the defects in workmanship and materials specified in clause 2 below for the expected life of the Hills Antenna Product.

• 1.3 The Bitek entities listed below distribute Hills Antenna Products in Australia, and assist Hills ATV to manage warranty claims in accordance with the terms of this Warranty. For the purposes of clauses 4.2.2 and 4.3 below, Bitek means the Bitek entity specified below for a state as applicable:
• 1.3.1 Bitek Pty Limited (ACN 084 308 207) - 11 Sheppard Street, Hume, ACT 2620, Telephone 02 6260 1874, Email enquiry@bitek.com.au;
• 1.3.2 Bitek (NSW) Pty Ltd (ACN 637 471 017) - Unit 7, 463 Victoria Street, Wetherill Park, NSW 2164, Telephone 02 9659 2272, Email enquiry@bitek.com.au;
• 1.3.3 Bitek (Victoria) Pty Limited (ACN 103 071 638) - 7/1 Culverlands Street, West Heidelberg, VIC 3081, Telephone 03 9456 9222, Email enquiry@bitek.com.au; and
• 1.3.4 Bitek (South Australia) Pty Limited (ACN 142 116 587) - 1 Temple Court, Ottoway, SA 5013, Telephone 08 8395 4111, Email enquiry@bitek.com.au.
• 1.4 Subject to clauses 2, 3 and 4 below, if the Hills Antenna Product is defective within its expected life and is returned to Bitek in accordance with clause 4 below, Hills ATV in its sole discretion will repair the Hills Antenna Product or replace it with an identical or similar product.
• 1.5 This Warranty is provided to the original end user purchaser of the Hills Antenna Product subject to that purchaser registering its purchase at Lifetime Warranty Registration, within 1 months of the purchase of the Hills Antenna Product. This warranty is not transferable to any subsequent end user or purchaser of the Hills Antenna Product. Please retain the original purchase docket, tax invoice or receipt as proof of purchase. The rights and remedies under the Australian Consumer Law, as set out at 1.6 and 1.7 below, apply to the Hills Antenna Product in the event that registration for a Lifetime Warranty is not made in accordance with 1.5 above.
• 1.6 The benefits conferred by this Warranty are in addition to all rights and remedies in respect of the Hills Antenna Product that a person has under the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010 and similar state and territory laws. Nothing in this Warranty is intended to contract out of the Australian Consumer Law.
• 1.7 The Australian Consumer Law requires the inclusion of the following statement in this Lifetime Warranty:
  Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

2. Inclusions

For the purposes of clause 1.2 above, this Warranty covers the following defects in workmanship and materials:

• 2.1 Aluminium Elements
• 2.1.1 Loose or rattling element(s) from BoomLock assembly;
• 2.1.2 Aluminium boom cracking or snapping at mounting point; and
• 2.1.3 Painted antennas surface coating lifting or flaking powder coat.
• 2.2 Plastic Components
• 2.2.1 Broken parts, cracking or snapping.
• 2.3 Corrosion
• 2.3.1 Corrosion other than that resulting from normal wear and tear, being corrosion to a part or element of the antenna where the whole of the surface area of the part or element has rusted, and is presenting with bright red discolouration.
• 2.3.2 Where a part or element rusts through causing the Hills Antenna Product to fall or be un-usable.

3. Exclusions

For the purposes of clause 1.2 above, this Warranty does not cover:

• 3.1 any defects caused by an accident, misuse, abuse, malicious or intentional acts to damage, weather phenomenon (bushfire, storm, lightning, wind, hail, flood), impact from another object, lack of reasonable care, unauthorised modification, loss of parts, tampering or attempted repair by a person not authorised;
• 3.2 any defects caused by wildlife or vermin damage;
• 3.3 any defects caused by electrical faults, fire or power surges;
• 3.4 defects caused by a failure to install, operate or maintain the antenna properly and adequately in accordance with the instructions provided with the Hills Antenna Product;
• 3.5 any Hills Antenna Product that has been used for purposes other than usual domestic use or commercial use;
• 3.6 expected or normal wear and tear to parts or elements not impacting the use or performance of the Hills Antenna Product, including but not limited to environmental exposure causing:
• 3.6.1 discolouration;
• 3.6.2 minor surface cracking or corrosion;
• 3.6.3 minor chalking or oxidisation.
• 3.7 any damage, including to PCB balun, caused by incorrectly fitted sealing boot;
• 3.8 any Hills Antenna Product installed or used in or on a marine vessel or application, or installed or used in any location or application affected by elevated levels of atmospheric salt, including marinas, jetties and water vessels.

4. Making a Lifetime Warranty Claim

• 4.1 If a defect in the Hills Antenna Product appears, cease using the Hills Antenna Product.
• 4.2 To validate and make a claim under this Warranty:
• 4.2.1 The purchase of the Hills Antenna Product must be registered using the registration form for the Hills Antenna Product within 1 month of the original purchase of the Hills Antenna Product. The registration form is found on Bitek's website at Lifetime Warranty Registration, and requires details of the purchase to be provided and a copy of proof of purchase to be uploaded.
• 4.2.2 In the event of a Warranty claim, claims can be submitted by contacting your nearest Bitek entity using the details provided in clause 1.3 above, or by filling out the smart form on Bitek's website accessed at Lifetime Warranty Claim. When submitting a claim, you will be required to provide details about the Hills Antenna Product, the purchase and the defect, as well as proof of purchase and photographic evidence.
• 4.3 You may be required to return the Hills Antenna Product to the place of purchase, a Bitek address in clause 1.3 above, or Hills ATV address in clause 1.1 above, so that Hills ATV can carry out an examination of the Hills Antenna Product. You will be responsible for all costs in returning the Hills Antenna Product to Hills ATV and or Bitek. Please ensure the Hills Antenna Product is properly packaged to ensure that no damage occurs to the Hills Antenna Product during transit.
• 4.4 If on behalf of Hills ATV it is determined that a defect in the Hills Antenna Product is covered by this Warranty, Hills ATV will in its sole discretion either repair or replace the Hills Antenna Product. If the specific model of Hills Antenna Product is not available at the time of a claim, Hills ATV may replace the product with the nearest equivalent product.
• 4.5 If it is determined that there is a defect in the Hills Antenna Product covered by this Warranty, you will be responsible for the following costs:
• 4.5.1 freight costs involved in returning the repaired or replacement product to you; and
• 4.5.2 any labour, equipment or disposal costs involved in removing or installing the repaired or replacement Hills Antenna Product.
• 4.6 If on behalf of Hills ATV it is determined that there is no defect in the Hills Antenna Product which is covered by this Warranty, Hills ATV reserves the right to invoice you for any costs incurred in relation to your claim, including attending a service call, parts, labour and return freight if required.

5. Limit on Liability

Subject to clauses 1.6 and 1.7 above.

• 5.1 Hills ATV and Bitek will not be liable for any Warranty or representation as to the quality or otherwise of the Hills Antenna Product unless stated above or implied by mandatory operation of law; and
• 5.2 Hills ATV and Bitek will not be liable in any event for any loss of profits or other indirect or consequential loss arising out of any defect in the Hills Antenna Product.
• 5.3 Hills ATV and Bitek will not be responsible for any loss or damage to the Hills Antenna Product that occurs during transit in accordance with clauses 4.3 and 4.5.1 above.
